Terms of Service

1. Who we are

TalkWith is operated by [Contracting entity — TBD] ("TalkWith", "we", "us"). These terms are a contract between us and the organization or person who opens a TalkWith account ("you"). If you use TalkWith on behalf of a company, you're accepting for that company.

2. What the service is

TalkWith provides embeddable video calling: hosted media infrastructure in the EU, APIs and SDKs to put calls in your product, optional call recording, and — when available — in-call AI features such as transcription and summaries. You build the product; we carry the calls.

Features labeled "coming soon" (including in-call AI) are not part of the service until we say they've shipped, and nothing labeled that way is billed.

3. Your account and keys

You're responsible for what happens under your account and API keys. Keep secret keys secret — they mint access to your rooms. If a key leaks, rotate it in the dashboard immediately; we're not responsible for usage minted with keys you failed to protect.

4. Acceptable use

Don't use TalkWith to:

  • break the law, or help anyone else break it;
  • harass, exploit, or harm people, or distribute content that does;
  • record or process calls without the consent the law requires from participants —obtaining participant consent for recording and AI processing is your responsibility, and our tooling is consent-gated to help you meet it;
  • probe, overload, or circumvent the platform's limits, metering, or security.

We can suspend accounts that put other customers, the platform, or call participants at risk.

5. Plans, billing, and spend caps

Current prices are on the pricing page. The free plan stops hard at its included minutes — no card, no bill. Paid plans include a monthly base fee and metered usage billed at the end of each billing month. Every paid organization has a spend cap (default €50/mo) that you can raise, lower, or remove; we stop serving new calls rather than exceed it. Prices can change with at least 30 days' notice; changes never apply retroactively.

6. Your content

Calls, recordings, and anything your users transmit through TalkWith are yours. You give us the limited rights needed to operate the service — to carry the media, store recordings you asked for, and run the processing you enabled. We don't use your call content to train models or for advertising.

7. Availability

We run TalkWith carefully but offer no uptime SLA at launch. We may change or discontinue features with reasonable notice; if we ever discontinue the service itself, you'll get at least 90 days and a way to export your data.

8. Liability

To the extent the law allows: the service is provided "as is"; neither side is liable for indirect or consequential losses; and our total liability in any 12-month period is capped at the fees you paid us in that period. Nothing here limits liability that can't legally be limited.

9. Ending things

You can close your account at any time from the dashboard. We can terminate for material breach of these terms (with notice and a chance to fix it where that's reasonable). On closure we delete your data on the schedule in the privacy policy.

10. Changes to these terms

If we change these terms in a way that matters, we'll email the account owner at least 30 days before the change takes effect. Continuing to use TalkWith after that is acceptance.

11. Governing law
